Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ('AUP') defines acceptable and prohibited activities on CyberNex infrastructure. All customers, resellers and downstream users are bound by this policy.

2. Prohibited Content and Activities

You may not engage in any activity on CyberNex infrastructure that: • Violates applicable law, regulation or court order • Involves the sale, distribution or creation of illegal, counterfeit or pirated goods • Engages in phishing, spoofing, social engineering or credential harvesting • Hosts, distributes or facilitates malware, ransomware, or malicious code • Conducts or facilitates network attacks including DDoS amplification, port scanning or vulnerability exploitation • Stores or transmits child sexual abuse material (CSAM) — violations will be reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement without delay

3. Resource Limits

CPU, RAM, bandwidth and disk usage must remain within the stated limits of your plan. Persistent or aggressive overconsumption — including cryptomining without explicit written permission, file hosting designed to exceed bandwidth caps, or jarring / abuse of background tasks — will result in an immediate process kill and, if repeated, service suspension.

4. Email and Messaging

Bulk or unsolicited email (spam), cold outreach from shared IP ranges, and the use of CyberNex infrastructure to send mail to purchased or harvested list addresses is strictly prohibited. Each confirmed spam incident carries a $500 penalty plus immediate service termination.

5. Gaming Server Rules

Game servers must comply with the End User License Agreement (EULA) of the relevant game publisher. Servers facilitating exploits, cheats or custom game clients that violate IP rights will be suspended. TeamSpeak and Discord bot services must not be used to harass, threaten or doxx other users.

6. Enforcement

Violations may result in: a formal written warning → throttle or quarantine → service suspension (with or without prorated refund) → permanent blacklisting from all CyberNex services. The severity of the response is proportionate to the violation, history of repeat offenses and the impact on other customers.

7. Reporting Violations

If you become aware of any AUP violation, please report it immediately to [email protected] with as much detail as possible (IP, timestamp, evidence). Reports are treated confidentially.

8. Reinstatement

Reinstatement of suspended services following an AUP violation is at CyberNex's sole discretion and contingent upon a signed behavioural undertaking or compliance audit. No reinstatement is guaranteed.
