1. Acceptance of Terms
By accessing or using any CyberNex Service you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our services.
2. Description of Services
CyberNex provides hosting infrastructure including game server hosting, VPS, VDS, Discord bot hosting, TeamSpeak hosting, FiveM DNS, and proxy/internet plans. Features, pricing and uptime guarantees are described on the CyberNex website and are subject to change without prior notice.
3. Account Registration
You are responsible for maintaining the confidentiality of your account credentials. You must be at least 13 years of age to create an account. You agree to provide accurate, current and complete registration information and to update it as needed. CyberNex reserves the right to suspend or terminate accounts that provide false or misleading information.
4. Billing and Payments
All fees are billed in advance on a monthly or yearly basis unless otherwise stated. Automatic renewal applies unless cancelled before the renewal date. We accept all major credit and debit cards, PayPal, Stripe, SEPA bank transfers and BTC, ETH, USDT. Failure to pay outstanding invoices may result in service suspension after 48 hours of non-payment. Chargebacks and payment disputes must be opened through your payment provider within 60 days of the charge.
5. Refund Policy
A 7-day no-questions-asked money-back guarantee applies to all new orders. After day 7 refunds are prorated based on your remaining billing period. Hardware/Root VDS plans carry a 3-day refund window. Abuse of the refund policy (e.g. serial refund buyers, shared-account refunds) may result in account termination and permanent blacklisting.
6. Acceptable Use
You agree not to use CyberNex services for any unlawful purpose, including but not limited to: distributing malware, phishing, DDoS attacks, copyright infringement, hosting illegal content, running botnets or cryptocurrency mining without prior written consent. CyberNex reserves the right to inspect, restrict or remove any content that violates this section without liability.
7. Service Suspension and Termination
CyberNex may suspend or terminate your account immediately and without notice for AUP violations, repeated payment failures, abuse of support resources, or any activity that poses a risk to our infrastructure or other customers. Upon termination all data will be purged within 30 days unless a competing legal hold is in effect.
8. Data Ownership and Backup
You retain full ownership of all data stored on your server instance. CyberNex does not inspect, access or monitor your server content by default. You are solely responsible for backing up your own data. Automated backups are provided as a courtesy feature — not a guarantee — and CyberNex is not liable for data loss.
9. Uptime and Availability
CyberNex targets 99.99% monthly uptime across VPS, VDS and game server plans. Scheduled maintenance windows will be announced via the Status page and Discord community at least 24 hours in advance. Sweeping infrastructure failures outside our direct control (e.g. upstream fibre cuts) are excluded from SLA calculations.
10. Limitation of Liability
CyberNex is not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the services, including but not limited to lost profits, lost data or reputational harm. Our total aggregate liability shall not exceed the amount paid by you for the affected service in the preceding 3 months.
11. Intellectual Property
All trademarks, logos, names, designs and content on CyberNex infrastructure and marketing channels are the property of CyberNex or its licensors. You may not reproduce, distribute or create derivative works from any CyberNex intellectual property without explicit written permission.
12. Indemnification
You agree to indemnify, defend and hold harmless CyberNex, its directors, employees and agents from any and all claims, damages, obligations, losses, liabilities, costs or debt arising from your use of the services, breach of these terms, or violation of any applicable law.
13. Changes to Terms
CyberNex reserves the right to modify or replace these terms at any time. Material changes will be announced via the Status page or email at least 7 days before they take effect. Continued use of the services following any changes constitutes acceptance of the new terms.
14. Governing Law and Jurisdiction
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or relating to these terms shall be resolved exclusively in the courts of London, United Kingdom.
